Introduction

These terms of use (hereinafter the "Terms") apply to your use of the Budgeez - Cash stuffing application. The application is owned and operated by the sole proprietorship of Benoit Bauchet, a natural person (hereinafter "the sole proprietorship"). It is located at 22 bis rue de la haute Bercelle, 77300 Fontainebleau. It holds the following SIREN number: 833 404 569 and is exempt from registration with the Trade and Companies Register (RCS) and the Trades Register (RM) (hereinafter referred to as "Budgeez," "we," "us," or "our").

Acceptance of our Terms

Access to the services offered by Budgeez is subject to acceptance of the conditions described below, which Budgeez is free to modify at any time and without notice. Using our services involves processing your information as described in our privacy policy. We invite you to read it. Users are invited to regularly refer to the latest version of these Terms, available at all times at the following address: https://www.budgeez.com/privacy-policy

This version of the Terms is dated 12/8/2023.

The French version of this document prevails over all other languages.

Intellectual property

The Budgeez name and all its logos are registered trademarks. You are not authorized to use these trademarks for any personal purpose whatsoever. The Budgeez user agrees not to reproduce, copy, sell, barter, or transfer all or part of Budgeez’s services, under any pretext. The user also agrees not to obscure or modify our services (the Budgeez brand or advertisements, for example).

Brief product description

The Budgeez application (hereinafter the "application") is a B2C mobile application. Its purpose is to make it easier for the natural person user (hereinafter the "user") to manage their personal finances. It allows:

• • a connection to the user’s bank account(s), thereby retrieving all transactions carried out,
• • the creation of a monthly budget using envelopes. The user sets a fixed monthly budget, which is used to fund as many envelopes (spending categories defined by the user) as desired. The user can then classify their transactions (debits and credits) into these envelopes, which decrease or increase the virtual available amount.

Budgeez is accessible only via mobile applications.

Appropriate use

Budgeez is suitable only for personal use, or possibly for couples/housemates (when individuals have a joint account). In case of use by couples or housemates, trust must prevail between users throughout the use of Budgeez.

Access to Budgeez services

The services are available on the Budgeez mobile apps, only upon acceptance of these Terms. The following are also required:

• • creation of a personal account (providing an email address and a password). Sign-in is also possible via Google, Apple, or Facebook.
• • linking the Budgeez account to the user’s bank accounts via our partner GoCardLess.

Access conditions

You may not use Budgeez if the laws of the applicable jurisdiction prohibit you from receiving services as we provide them, if we have previously banned your account for violating these Terms, or if you are not of legal age to accept terms of use.

The Service is not intended for persons under 16 years old, and we ask such persons not to provide personal information through the Service. If your child has submitted personal information and you wish to request that such personal information be deleted, please contact us at [email protected] or by mail at 22 bis rue de la Haute Bercelle, 77300 Fontainebleau.

As a Budgeez user, you must at all times: provide accurate data to Budgeez; always verify information concerning you.

As a Budgeez user, you expressly agree NEVER to: transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, racist, or otherwise objectionable; transmit content that violates a patent or a registered trademark; harm other users in any way; harass one or more other users in any way; attempt to deceive or mislead other users; use Budgeez in email chains ("hoaxes"); intentionally hinder or disrupt our services; use Budgeez in a manner contrary to French law; violate, intentionally or not, any applicable national or international law or regulation and all other rules having the force of law; reproduce, copy, sell, resell, or exploit for any commercial purpose any part or use of our services, any right of access to our services.

Budgeez is in no way responsible for the accuracy or precision of the data you enter in Budgeez (notes associated with transactions, created envelopes, categorization). Budgeez should be seen only as a tool for categorizing expenses — expenses that the application merely retrieves via our partner GoCardLess from your bank account. In case of discrepancy between transactions retrieved via Budgeez and your bank account statement, your bank account statement prevails. In all cases, your account balance and transactions displayed on your bank account prevail. Under no circumstances can Budgeez be held responsible for transactions made by the user on their bank account. Budgeez also cannot be held responsible, of any kind whatsoever, for direct or indirect damages resulting from: inappropriate use of its services; use deemed illegal or fraudulent of its services; inaccurate data on an account; erroneous results provided by its services; temporary or lasting unavailability of its services; any failure of its services; any cause related to its services.

Warning

Shared use of Budgeez must NEVER have any contractual value in the eyes of users. For the tool to work properly, it is important that those who have access to the same account are morally or contractually bound to each other.

Your Budgeez account is personal; it may possibly be shared with your spouse/housemate (only when using the app with a joint account). IT IS IMPORTANT NEVER TO SHARE YOUR LOGIN DETAILS WITH PEOPLE WHO ARE NOT DIRECTLY INVOLVED IN THE ACCOUNTS OR WHOM YOU CONSIDER IRRESPONSIBLE!

The likelihood of someone finding your login details "by accident" is practically zero. Nevertheless, it is not impossible for a stranger to obtain them: they can be intercepted by a hacker, recovered from a computer’s memory, or simply copied from your browser history. It is not recommended to store confidential information on Budgeez. If the user does so, it will be at their own risk. If you suspect that a stranger is accessing your accounts, delete the account immediately and create a new one! You understand that Budgeez cannot be held responsible for the use that you, your spouse, or housemate make of the link to your account.

Suspension and interruption of access to services

Budgeez has the right to stop its services (or part of them) temporarily or permanently, to delete or modify them, or to introduce new ones without notice. Budgeez reserves the right (but is not obliged) to delete a Budgeez account or ban one or more users without any justification and without prior notice.

Leaving Budgeez

When you delete your Budgeez application, your Budgeez account and associated data will not be deleted. You can download the app again, log in to your account, and find it as it was.

Permanently deleting your Budgeez account

The user can delete their account from the Budgeez app, in the "Profile" tab, by clicking the "delete my account" button.

All of their data is deleted immediately.

Privacy

To provide the services, Budgeez and GoCardLess collect certain personal information about you. A description of the collection and use of personal information can be found in our politique de confidentialité. Please read this policy before using Budgeez. You must be 16 years of age or older to use this service.

Advertising

The Budgeez application is not financed by advertising in any way.

Subscription to additional features

Budgeez reserves the right to implement additional features/to allow the use of the app and Budgeez services via a paid subscription. If paid features/subscriptions are introduced, users will be notified. They will be free to delete their account if they do not wish to subscribe. Such subscriptions will, where appropriate, be managed by platforms such as Google Play, Apple App Store, or Huawei AppGallery.

Governing law and jurisdiction

These Terms of Use are governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of the Paris courts.
